Terms of Use

These terms cover the Hatchfire app (the "game") and the website at playhatchfire.com (the "site"). The game is made by Kelby Corr, an independent developer publishing as Stonemill Studios ("we", "us"). By playing the game or using the site, you agree to them.

1. Playing the game

We give you a personal, non-transferable licence to install and play the game on devices you own or control, as the App Store's or Google Play's rules allow. The game is licensed to you, not sold. On iPhone, Apple's standard Licensed Application End User Licence Agreement also applies to the app; on Android, Google Play's terms do.

2. Age

You need to be at least 13 to use the game or the site. If you're under the age of majority where you live, a parent or guardian needs to agree to these terms for you.

3. The purchase

• The game is free to start. One optional purchase opens the rest of it.
• It's a one-time purchase, not a subscription. It belongs to the Apple or Google account that bought it and can be restored on your other devices from the game's Settings.
• Apple or Google takes the payment and sets the price in your currency. Refunds are handled by them, under their refund rules. We can't issue them ourselves.
• There are no other purchases, and nothing in the game can be bought with real money beyond this.

4. Your save

Your progress is stored on your device. If you turn on cloud saves, a copy is also kept on our server so you can carry on from another phone. We do our best to keep it safe, but we can't promise to restore lost progress. Deleting the app deletes the save on your phone, although your purchase can always be restored.

5. Playing online

Waymeet, chat, friends, player cards and raids are shared with other players. Online, please keep it friendly:

• no hate, harassment, threats or bullying;
• no sharing personal details, yours or anyone else's;
• no names, crests or messages that are offensive or impersonate someone;
• no cheating, exploiting bugs or using other programs to play for you.

Typed chat is for players 13 and over who have accepted these rules. You can report or block a player from their card. Moderators may reset a name, mute chat, take down a card, or suspend an account, for a time or for good. The online parts may sometimes be closed for maintenance, and may change or end; the game still plays offline.

6. Beta versions

Test versions are unfinished. They may have bugs, their balance may change, and a save from a test version may be reset. Feedback you send us may be used to improve the game without payment or credit, though we're grateful for it.

7. Fair use

Please don't:

• copy, resell or redistribute the game or its art, music and writing;
• get round the purchase or tamper with the game to unlock paid content;
• use the game or the site for anything unlawful, or to harm other people;
• attack, overload or scrape the site in a way that disrupts it.

8. Ownership

The game, its name, art, sound, writing and code belong to Kelby Corr. Sharing screenshots and videos of your own play is welcome, including in monetised videos and streams.

9. No warranty

The game and the site are provided as they are. We work to keep them running well, but to the extent the law allows we don't promise they will be free of errors or always available. Nothing here limits rights you have under consumer law that can't be limited.

10. Limit of liability

To the extent the law allows, we aren't liable for indirect or consequential losses from using the game or the site, including lost game progress, and our total liability to you is limited to what you paid for the game.

11. Changes

We may update these terms as the game changes. The date at the top shows the latest version. Carrying on playing after a change means you accept it.

12. Law

These terms are governed by the laws of the place where the developer lives, without regard to its conflict-of-law rules, except where the consumer law of your own country gives you rights that can't be set aside.
